Whilst we prefer a client's legal advisers to undertake lasting powers of attorney we do for some clients undertake the task on their behalf. Unlike most solicitors we always put the LPA into force despite the fact that the individual giving the LPA is in perfect health.
We sent our last set of LPAs into the OPG on the 12th April. We got them back of the 11th July. That means if we had waited to register the LPAs until we needed them we would have had a 12 week delay before we got them in force.
Whilst the OPG are so slow and the forms so complex (meaning they can be returned when small mistakes are made) we remain of the view that LPAs should be put into force when written rather than when needed.
